Terms of Use

1. What is Flow Card

Flow Card is a personal business prospecting tool: using a photo or manually entered data, it extracts contact information and generates AI-powered research on the associated company. It is operated by Flowtify AI LLC ("we," "us," "Flow Card"). By creating an account or using the app, you agree to these Terms and our Privacy Policy.

2. Your Account

You need an account (email and password) to use the app. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Each account is for individual use — it is not intended to be shared among multiple people.

3. Third-Party Data You Upload

Your role as data controller. When you photograph or enter data about a person or company (a business card, a public profile, information from a professional event), you assume the role of data controller for that information. Flow Card acts as a data processor — it processes the data you choose to upload, under your instruction, and makes no independent decisions about its use.

Your responsibilities include:

  • Having a legitimate basis to collect and process that information. Valid examples include: having received the card directly from that person in a professional context, the information being publicly available business data, or having a prior relationship with that person or company.
  • Using the data in compliance with applicable data protection laws in your jurisdiction and that of your contacts.
  • Not using the platform to collect data about individuals with whom you have no prior relationship or interaction.

What Flow Card does not do. We do not verify whether you have a legal right to collect any particular piece of data. We are not responsible for how you use the information you store.

4. Acceptable Use

You may not use Flow Card to:

  • Collect data about individuals without a legitimate basis for doing so.
  • Send spam, harassment, or unsolicited communications to saved contacts.
  • Attempt to access other users' accounts or data.
  • Use the app in a manner that violates applicable data protection laws in your jurisdiction.
  • Collect data about minors.

5. Paid Plans and Billing

Paid plans are billed monthly through Stripe. You may change or cancel your plan at any time from your profile; cancellation is immediate (no proration of the current billing period) and your account reverts to the free plan. Unless required by applicable law, payments already made are non-refundable.

6. AI Research and Web Analysis — Scope and Limitations

The app uses artificial intelligence models for two functions:

a) Contact extraction. Data from the card or image is processed by AI to identify and structure name, title, company, phone number, email, website, and other fields. This extraction may contain errors — always verify the data before relying on it.

b) Company research and fit score. The app searches publicly available information on the web about the company associated with the contact. Using that information, it generates a "fit score" and suggested conversation points.

Regarding this research:

  • It is generated automatically, without human review on a case-by-case basis — it constitutes automated profiling for commercial prospecting purposes.
  • It may be outdated, incomplete, or contain errors.
  • The fit score is an indicative estimate, not a verified professional analysis.
  • It should not be used as the sole basis for making business, investment, or any other type of decision.
  • Web searches access publicly available information. Some websites may restrict automated access in their own terms of use — Flow Card does not guarantee compliance with third-party website terms of use and is not responsible for information obtained from sites that change or remove content.

7. Intellectual Property

You retain all rights to the data you upload. Flow Card retains all rights to the app, its design, and its code. You may not copy, resell, or redistribute the app without authorization.

8. Limitation of Liability

Flow Card is provided "as is," without warranties of any kind. To the maximum extent permitted by applicable law, Flowtify is not liable for indirect damages, loss of business, or decisions made based on information generated by the app, including the AI research described in Section 6.

9. Account Termination

You may delete your account at any time. We reserve the right to suspend accounts that violate Section 4 (Acceptable Use).

10. Changes to These Terms

We may update these Terms from time to time. If a change is significant, we will notify you by email or within the app before it takes effect.

11. Governing Law

These Terms are governed by the laws of the State of New Jersey and applicable federal laws of the United States of America, without giving effect to any conflict of law provisions. For any dispute that cannot be resolved amicably between the parties, the parties agree to submit to the jurisdiction of the competent courts of the State of New Jersey.
